These Terms and Conditions (“Terms”) govern your access to and use of BrandFuel AI Employee and all related services provided by BrandFuel.co (“BrandFuel,” “we,” “us,” or “our”).

By using the Services, you agree to these Terms.

1. Services Description

BrandFuel AI Employee provides AI-powered automation tools including (but not limited to):

  • AI phone agents

  • AI chat and messaging

  • CRM automation

  • Scheduling and follow-up systems

Services rely on third-party platforms and artificial intelligence technologies.

2. No Guarantees

BrandFuel makes no guarantees regarding:

  • Revenue, leads, conversions, or business results

  • Accuracy or reliability of AI responses

  • Compliance with laws or regulations

  • Availability or uptime of third-party systems

3. User Responsibility & Control

You acknowledge that:

  • AI Employee operates based on your configuration and inputs

  • You are solely responsible for how AI is used in your business

  • You must actively monitor, review, and manage AI behavior

AI Employee is a tool—not a replacement for professional judgment, legal advice, or human oversight.

4. Hold Harmless & Indemnification

You agree to fully indemnify, defend, and hold harmless BrandFuel.co, its owners, employees, contractors, partners, affiliates, and technology providers from any and all claims, damages, losses, liabilities, fines, penalties, costs, or legal fees arising from:

  • Use or misuse of AI Employee

  • AI-generated communications or decisions

  • Customer disputes or complaints

  • Regulatory or legal violations (including TCPA, privacy, recording laws)

  • Business losses or reputational damage

  • Actions taken based on AI outputs

This obligation survives termination of your account.

5. Compliance Obligations

You are solely responsible for compliance with:

  • TCPA and telemarketing laws

  • Recording consent laws

  • Privacy regulations (GDPR, CCPA, etc.)

  • Industry-specific rules (medical, legal, financial, etc.)

BrandFuel does not provide legal compliance services.

6. Payment & Subscription Terms

  • Fees are billed in advance

  • All payments are non-refundable unless explicitly stated

  • Usage-based fees may apply (calls, texts, AI interactions)

  • BrandFuel may suspend service for non-payment

7. Intellectual Property

All BrandFuel software, branding, systems, and materials remain the exclusive property of BrandFuel. You receive a limited, non-transferable license to use the Services.

8. Termination

BrandFuel may suspend or terminate access at any time for:

  • Violation of these Terms

  • Abuse or misuse of Services

  • Illegal or unethical activity

You may cancel according to your subscription terms.

9. Limitation of Liability

To the fullest extent permitted by law, BrandFuel’s total liability shall not exceed the amount paid by you in the previous 30 days.

BrandFuel shall not be liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

11. Changes to Terms

BrandFuel may update these Terms at any time. Continued use constitutes acceptance.
